Conditions of guarantee
Milan Vrzal company, IČ 63929872, domesticated U Uranie 1206/11, 170 00 Praha 7, Czech republic (further just producer) provides guarantee for the kite-line adjustment equipment (further just product) under the following conditions:
The producer provides guarantee for this product over a period of 24 months starting on the date of the take-over from the seller. During this timeperiod the producer provides repair of the product free of charge.
The guarantee relates only to defects caused by material shortcoming or a manufacture deficiency that appear during the guarantee-time. The guarantee does not relate to defects caused by regular detrition.
Your guarantee rights are invalid in the following cases :
when the damage of the product is caused by transportation (this must be solved with the transport company)
when the damage is caused by unskilled manipulation or use which is out of accord with the manual
when using the product with a type of kite that does not correspond with the parameters described in the manual
mechanical damage, overburdening, poor maintainance, modification of the product
damage of the product by natural elements
when defect detected the user shall put in a claim for reparation without linger. The user will send the defected product together with the recipted bill of purchase to the producers adress. In case of a rightful claim the producer will send back a new product on the adress given by the user. The producer reserves the right for changes made in order to improve the product.
The conditions listed in this guarantee list are not contradictory to any rights of the costumer which relate to the purchase.
The procedure of exchange, return or reclamation:
First inform us by e-mail about the exchange, return or reclamation.
After agreement send the packege to our adress. Do not send it cash on delivery- these packages will not be accepted due to shipment checking.
The package must contain a valid bill of purchase, a brief description whether it is a exchange, return or reclamation, your adress, e-mail and phone. In case of exchange note the product you want to exchange for. In case you want to return the product and get your money back note your bank account numer.
After the returned product-check we will forthwith pay back the full price of the product by post remittance or transfer, or send a new product of your choice.
Limitation of liability
The producer is not responsible for damages caused by using the product for different purposes then what it was designed for.
The producer is not resoponsible for any injury, property or health damage caused by wrong manipulation or by not fulfiling the prosedure written in the manual.
This product has been constructed so it can not cause damage on the kite when used properly.
Safety instructions
This product is not a toy. Do not let children without supervision, there is injury danger. Use the product only to the purposes it was designed for, be particular about the correct attachment of Jose to your kite, this may precede injury during manipulation.

The trading conditions are valid until declaring new trading conditions.
PURCHASE ORDER
The purchase agreement whereupon the trade of the seller and the buyer is realized generates on the basis of a definite conformation of the order. The definite conformation is considered to be a conformation by e-mail or phone which followes the previous electronic order (a conformation about receiving your order into the system is not an order conformation). Most likely the seller will contact you to do the definte conformatin of your order after checking the availability and the date of delivery of the requested items. The conformation of the order (or part of it) by the seller is considered to be binding for both sides if the conditions under which the agreement has been placed do not change. We considere as the most important conditions primarily the content of the order ( the exact specification of the items and their amount), the price of order, the delivery fee and the date and form of delivery.
THE RIGHTS AND DUTIES OF THE SELLER
The seller has the right to back out of the purchase agreement if the buyer does not fulfil to pay or to take over the ordered products.
The seller has the right to back out of the purchase agreement in case it becomes unrealizable if he does not come to a new agreement with the buyer. In case the order has been payed ahead (with card or bank transfer) and the seller has to back out of the deal for mentioned reasons, the seller will return the whole sales price to the buyer within 30 days from the date of posting the written avoidance of contract.
The fulfilment of the contract becomes unrealizable mostly in cases when the requested item is not being manufactured or provided to the market anymore. The seller will contact the buyer about the disability to fulfil the purchase agreement as soon as possible after detecting this.
THE RIGHTS AND DUTIES OF THE BUYER
The buyer is obliged to give a valid and complete delivery adress.
The buyer is obliged to take over and pay the full price of the order. The buyer is acquainted with the final sales price when filling out the order, before the definite purchase conformation.
The buyer is obliged to take over the order from the transporter, check the inviolacy of the package, the amount of packages and in case of any damage immediately give notice to the transporter. By undersighning the delivery note the buyer affirms that the package fulfils all conditions listed above and there will be no regard taken in case of later package defect reclamation.
CANCELLATION OF THE ORDER
Cancellation of the order on the part of the buyer
The buyer has the right to cancel the order at any time before the definite order conformation without reason. After the definite order conformation only in cases where the buyer can not fulfil the concerted conditions of the purchase. When canceling a confirmed order the buyer must cover the costs of the seller that herewith incurred.

In this situation the seller will immediately contact the buyer in order to settle on next proceeding. If the buyer has already payed part or the whole sales price, it will be returned as soon as possible ( maximum 10 week-days ).
AVOIDANCE OF THE PURCHASE AGREEMENT
As a costumer you have the right to rescind the purchase agreement within 14 days from delivery takeover. This right is contingent on trading as an individual (not on IČ). If you decide to rescind the purchase in this given time period we ask you to adhere the following conditions.
Let us know(by e-mail) about your wish to rescind the contract. Include the ID number of the order and the date of order.
If you have already received the ordered products send them back to the adress stated in the section contact under the following conditions.
the products must be in an undamaged original wrapping
the products must not be used
they must be undamaged
they must be complete ( incl. accessories, certificate of warranty, manual and so on)
together with the original proof of purchase
Please send the package by registered post and insure the products since we are not responsible for contingent loss when products are tranfered (registered post is not cash on delivery).
If all terms listed above are observed we will send your money back to your account by transfer or post remittance in maximum 14 days starting by the day of product takeover. In case the returned package is incomplete or otherwise does not fulfil the conditions listed above the date of payment will be shifted until delivery is full-featured.
In case of not fulfiling any of these conditions the seller will not accept the avoidance of the purchase agreement and the products will be returned on the buyers expenses.
TERMS OF DELIVERY
The product delivery will be fulfiled in the shortest possible time (usually between 5-10 week-days) from the date of the final order conformation depending on the availability and operating facilities of the producer. In rare cases the time of delivery may take longer.
The place of delivery is set by the buyer in the order. The delivery is considered succesful when the products reach the stated spot. The delivery is arranged by the seller. The package always contains a tax document and the products manual. The delivery costs are set according to the price of the order. When ordering more then 3 pieces of Jose the delivery fee is free of charge.

When using this internet shop you agree with acquisition and usage of information about you and your shopping activities under the above listed conditions.
SALE AND PAYMENT OF THE PRODUCTS
The seller is the owner of the products and those are being sold to the buyer (the customer). The products are the property of the seller until full payment of the products price. The payment is done by bank transfer. The full price of the order must be ascribed to the sellers account after subtracting transfer and other fees. If the order contains 4 or more pieces of Jose you do not pay the delivery fee.
FINAL PROVISION
These trading conditions are valid for purchase between Milan Vrzal company and the buyer. The buyer can be an individual as well as a corporation. A legal relationship between bouth contractors originated from the orders contract abide in case of an individual by the Civil Code and in case of a corporation by the Comercial Code.
The buyer accepts by sending the electronic order all trading conditions valid on the date of sending the order and also accepts the quoted price given in the e-shop catalogue if other conditions where demonstrably not set individualy before. As soon as the buyer obtains an order conformation from the seller, is the order including the price valid until the order is delivered, unless in special cases some of these conditions are set differently. The buyer is bound to the sent order during the time given for delivery and so is the seller by conforming the order.
In dependence on changes of the relevant legal rules as well as the company´s policy, Milan Vrzal company reserves all rights to change the trading conditions. This change and the date it is in operation will be announced in a suitable way on the internet site www.josekites.com
